Resident Change Request Process

When there are several people on the lease and one or more people want to move out now, and one or more want to stay, there is a process to request a tenant change. Please understand the Landlord/Owner is not obligated to grant the request. No changes in tenants may occur without the Owner/Owner’s Agent written consent. There must be at least one tenant remaining from the original lease. Vacating tenants are not removed from the lease.

Here are the steps to follow for your request to be considered.

1. Inform the office in writing who is moving out and the name(s) of the prospective applicant(s) via e-mail to Jason@jasonborn.com or through the online portal.

3. The remaining tenant must submit current proof of income to jason@jasonborn.com or to the dropbox.

4. Have each new incoming applicant(s) complete an application and submit their elements

5.  Once the applicant(s) completes the application and submits all elements, they will be sent an email request to visit the MySmartMove.com website to run their credit, background and criminal report.

6.  When all the elements and reports are collected, we send the request to the Owner/Owner’s Agent and you will be notified if the change is approved.

7.  If the resident change is approved, there is a processing fee due Born Property Management. The fees and charges are detailed on this link and you are required to send us the fee within 24 hours of the approval and prior to the Resident Change Request Amendment being drafted.

8. Once the payment has cleared, we will draft the Resident Change Amendment and add the new tenants to the existing Lease Agreement then send to all parties via DocuSign for electronic signature. The vacating tenants are not removed from the lease.

9. Once the Resident Change Request Amendment and Lease Agreement are signed, the departing tenants will be notified and removed from the online tenant portal system.

10. No amount of the Security Deposit is ever released to any outgoing Tenant by Born Property Management because the security deposit will be retained by Born Property Management on behalf of the owner until the Lease Agreement is terminated and all the tenants comply with the termination terms of the Lease Agreement. It is the responsibility of the new tenants to refund the security deposit to the departing tenants if appropriate. Q. How do I obtain the Owner/Agent written consent to assign my rental unit?

A. All incoming new applicants, staying tenants and leaving tenants must complete and sign all pages of the Resident Change Request Amendment and all proposed new applicants must submit a complete application including income statements, proof of identity and credit and background check. Finally, the Owner/Agent must approve of the change in writing.

 

Q. Can I assign or sublet the property?

A.  No.  Pursuant to the Lease Agreement, tenants shall not sublet all or any part of Premises, or assign or transfer the Agreement or any interest in it, without the Owner/Agent prior written consent.

 

Q.  If the Landlord does not approve of a resident change, what will happen?

A. Pursuant to the Lease Agreement, if the Landlord does not consent to a resident change, Landlord can terminate the Lease Agreement.

 

Q.  How do I request a Resident Change?

A.  Pursuant to most Lease Agreements, any proposed assignee, transferee or sublessee shall submit to Landlord an application and credit information for Landlord's approval and, if approved, sign a separate written agreement with Landlord and Tenant. Landlord's consent to any one assignment, transfer or sublease, shall not be construed as consent to any subsequent assignment, transfer or sublease and does not release Tenant of Tenant's obligations.
